BELM – General Terms and Conditions

Important:

Returns are not possible for custom-made products.

Article 1 – Identity of the Merchant

Article 2 – Applicability

These general terms and conditions apply to every offer by BELM and to all distance contracts and orders concluded between the merchant and the consumer.
Prior to concluding the contract, the text of these terms will be made available to the consumer.
Situations not covered by these terms shall be assessed in the spirit of these conditions.
Ambiguities in interpretation or content shall be resolved in alignment with the intent of these terms.

Article 3 – The Offer

  • Offers with limited validity or specific conditions will be explicitly stated.
  • All offers are non-binding. BELM reserves the right to modify or adjust offers.
  • Offers include a complete and accurate description of products/services, enabling the consumer to make an informed assessment.
  • Consumers must report damages or incomplete orders on the day of delivery.
  • Product images, specifications, and descriptions are indicative and cannot justify compensation or contract dissolution.

Article 4 – The Contract

  1. The contract is concluded upon the consumer’s acceptance of the offer and compliance with these terms.
  2. For electronic acceptances, BELM will confirm receipt immediately. The consumer may cancel until confirmation is sent.
  3. BELM implements technical/organizational measures to secure electronic data transfers and payments.
  4. BELM may assess the consumer’s ability to meet payment obligations and reserves the right to refuse orders or impose special conditions.
  5. The following information will accompany deliveries (in writing or durable format):

Article 5 – Right of Withdrawal

For products:

  • The consumer may dissolve the contract within 14 days of delivery without justification.
  • During this period, the product must be handled with care and returned in original packaging.
  • To exercise this right, notify BELM via the contact form within 14 days, then return the product within 14 days (proof of return required).
  • Exclusion: Custom-made/personalized products cannot be returned.

For services:

  • The consumer may dissolve the contract within 14 days of conclusion, following BELM’s instructions.

Article 6 – Costs of Withdrawal

  • Return shipping costs are the consumer’s responsibility.
  • Refunds will be issued within 14 days of withdrawal, contingent on product receipt and condition.
  • Consumers are liable for value loss due to mishandling, unless BELM failed to provide mandatory withdrawal information.

Article 7 – Pricing

  • Prices during the offer’s validity period will not increase, except for VAT rate changes.
  • All prices include VAT.
  • Typographical/printing errors exempt BELM from liability. Incorrect prices do not obligate fulfillment.

Article 8 – Conformity & Warranty

  • No warranty applies unless explicitly stated on the product page.

Article 9 – Delivery & Execution

  • BELM processes orders with due care. Delivery address provided by the consumer is definitive.
  • Orders are fulfilled within 30 days (unless a longer period is agreed). Delays will be communicated within 30 days, allowing free contract dissolution.
  • Delivery times are estimates; no compensation is owed for delays.

Article 10 – Complaints Procedure

  • Complaints must be submitted within 7 days of defect identification, with a detailed description.
  • BELM responds within 14 days (or provides a timeline for complex cases).
  • Unresolved complaints may be escalated to the EU ODR platformhttp://ec.europa.eu/odr.

Article 11 – Disputes

  • Dutch law applies exclusively, even for international consumers.
  • The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
